$1000 Minute
The following Terms and Conditions apply to David and Tanya's
$1000 Minute breakfast promotion to be run on 102.9 KOFM in Newcastle.
These Terms and Conditions apply in conjunction with KOFM’s General
Contest Rules. Where there is any inconsistency, these terms and conditions
will prevail.
These terms and conditions can be collected at the KOFM reception desk
at 252 Pacific Highway, Charlestown and can be downloaded from the website
at
http://www.kofm.com.au
1 METHOD OF ENTRY
KOFM will invite listeners who wish to play the “$1000 Minute”
competition to KOFM’s competition line on 4942 1029 when invited
to by the on-air announcers.
Once chosen to play, the participant is unable to play again for a period
of three (3) months. If the participant calls again and is selected within
this period of three (3) months, KOFM will randomly select another participant.
If a contestant wins the major prize in this competition, they will be
ineligible to play again for a period of six (6) months, and will be required
to sign acknowledgement of such to redeem their prize.
A failure by KOFM to enforce any of these rules in any instance(s) will
not give rise to any claim by any other person or contestant.
A maximum of five (5) contestants will be selected to play the $1000 Minute
throughout the week. The $1000 Minute will be played between 7.00am and
8.00am, Monday - Friday (except public holidays).
Each chosen participant will have 60 seconds to answer ten (10) trivia
questions. These questions will be set by KOFM in its absolute discretion.
Listeners may register more than once, however, once chosen to play, the
participant is unable to play again for another period of three (3) months.
If the participant’s name is selected again within this period of
three (3) months, KOFM will select another participant.
If the successful caller correctly answers all ten questions within 60
seconds they will win $1000. If they do not correctly answer all ten questions
within 60 seconds they will win a consolation prize.
The entrant must not have assistance provided to them by another person.
If KOFM becomes aware that a winner received assistance, the prize will
not be awarded, even if it seems at the time on-air that the contestant
has “won”.
The caller may pass on any question and come back to it if time permits.
They will not have the opportunity to correct any questions answered incorrectly
on the first attempt.
A caller will be judged to have correctly or incorrectly answered a question
according to the absolute discretion of KOFM staff and no discussions
or correspondence will be entertained.
If in the course of a telephone call the telephone line drops out or breaks
up KOFM retains the right to proceed to another caller. In such event,
KOFM will not be responsible for the awarding of any prize to the caller
whose line dropped out or broke up.
From time to time, KOFM’s announcers may provide clues as to what
may be contained in the $1000 Minute questions. This will be done at the
sole discretion of KOFM.
2 DURATION
The promotion will run weekdays at approximately 7:15am from Friday 24
April, 2009 until Friday 11 December 2009 (excluding public holidays).
THE PRIZE(S)
In the event that the contestant gets less than 10 questions correct,
they will be awarded a consolation prize per correct answer. Each consolation
prize will comprise a $1 “Scratchie” ticket.
If the contestant answers each of the 10 questions correctly, they will
be awarded a major prize. Each major prize will comprise $1000 cash.
There will potentially be approximately 165 contesting segments in total.
It is not possible to determine in advance the number of prizes which
will be won in these segments. The total prize pool will however be $10,000
and in the event that the whole prize pool has been won prior to 9:00am
Friday 11 December, 2009 the competition will be discontinued at that
point at the absolute discretion in all things of KOFM.
3 All prizes are non-transferable and consolation prizes are not redeemable
for cash.
4 In the event that the announcer becomes aware that the same person has
been the successful caller through more than once in either the 3-month
(or 6-month) period, that caller be disqualified and another caller taken
at the absolute discretion of KOFM staff. All decisions and actions of
KOFM shall be exercised according to the stations absolute discretion
and no discussion or correspondence will be entertained.
5 USE OF PHOTOS etc.
All contestants acknowledge that it is a condition of entry that KOFM
has the right to publicise their names, characters, likenesses or voices
for any promotion or matter incidental to the competition.
The winner may also be required by KOFM to participate in a photo, video
and/or film session and acknowledges that KOFM has the right to use such
publicity photos, videos and/or films in any medium and in any reasonable
manner it sees fit, unless that person advises KOFM at the time of entering
the competition that he/she wishes to retain his/her anonymity.
Contestants also acknowledge that their photo may be used for a promotional
display at the prize provider’s location.
It is a condition of entering this competition that contestants consent
to their entry being read out on air and to their telephone and other
conversations with KOFM being broadcast on air.
6 INDEMNITY
All contestants release from, and indemnify Radio Newcastle Pty Ltd (ACN
000 225 525) and Austereo Pty Ltd (ACN 007 914 641) against, all liability,
cost, loss or expense arising out of acceptance of any prize(s) or participation
in the competition including (but not limited to) personal injury and
damage to property and whether direct or consequential, foreseeable, due
to some negligent act or omission or otherwise.
7 NOTIFICATION
All prize winners will be notified on air at the time of the contest.
A telephone call will be made to all winners outlining prize and collection
details.
8 Winners of minor prizes will be required to pick up their prize from
the KOFM reception at 252 Pacific Highway, Charlestown. All winners must
present identification (incorporating a photograph) when collecting their
prize, and may be required to sign Terms & Conditions.
9 All winners will be responsible for any and all taxes incurred in relation
to their receipt of their prize.
10 Employees and their immediate families of KOFM and Radio Newcastle
Pty Ltd are ineligible to enter. Employees and their immediate families
of all associated sponsors and participating companies are also ineligible
to enter.
11 If the winner of the major prize is under the age of 18 years, that
prize may at the absolute discretion of KOFM be awarded to that winner’s
parent or guardian.
12 It is a condition of entry that all winners of all prizes must sign
these terms and conditions and the KOFM General Contest Rules both in
a form prescribed by Radio Newcastle Pty Ltd and present photo ID in order
to receive their prize.
14. In all matters, all decisions of KOFM staff will be final and cannot
be contested. No correspondence or discussions will be entertained.
15. The personal information supplied by entrants in entering this competition
will be used by KOFM to conduct the contest and to contact entrants if
they are selected. Please refer to our Privacy Policy for more information
as entry in this contest is an agreement to be bound by that policy. Our

KOFM reception.
16. PROMOTER
The promoter is Radio Newcastle Pty Ltd trading as KOFM of 252 Pacific
Highway, Charlestown.
